A BILL
for
1 AN ACT relating to the administration of government;
2 requiring personnel files of peace and corrections officers
3 and dispatchers to be available to the peace officer
4 standards and training commission as specified; and
5 providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 9-1-704 by creating a new subsection
10 (m), 9-1-708 by creating a new subsection (h), 9-1-710 by
11 creating a new subsection (o) and 16-4-203(d)(iii) are
12 amended to read:

1 9-1-704. Qualifications for employment as a peace
2 officer; loss of certification for felony conviction;
3 termination from employment.

5 (m) Notwithstanding any other law to the contrary,
6 the portion of a personnel file relevant to any of the
7 factors listed in W.S. 9-1-704(b) for any person employed
8 by a law enforcement unit as a peace officer shall be made
9 available to the commission upon written request of the
10 commission to the employing agency. The personnel file
11 shall not be disclosed by the commission to any other
12 person except as otherwise required by law.

14 9-1-708. Certificate required for permanent
15 employment; temporary employment; waiver or modification of
16 training requirements; wages during training; grandfather
17 provisions.

19 (h) Notwithstanding any other law to the contrary,
20 the portion of a personnel file relevant to any of the
21 factors listed in W.S. 9-1-704(b) for any person employed
22 as a dispatcher required to be certified under this section
23 shall be made available to the commission upon written

1 request of the commission to the employing agency. The
2 personnel file shall not be disclosed by the commission to
3 any other person except as otherwise required by law.

5 9-1-710. Qualifications for employment as a
6 correctional officer; termination of employment;
7 certification without compliance with the requirements of
8 this section.

10 (o) Notwithstanding any other law to the contrary,
11 the portion of the personnel file relevant to any of the
12 factors listed in W.S. 9-1-704(b) for any person employed
13 by the department of corrections as a correctional officer
14 or part-time correctional officer shall be made available
15 to the commission upon written request of the commission to
16 the department of corrections. The personnel file shall not
17 be disclosed by the commission to any other person except
18 as otherwise required by law.

20 16-4-203. Right of inspection; grounds for denial;
21 access of news media; order permitting or restricting
22 disclosure; exceptions.

1 (d) The custodian shall deny the right of inspection
2 of the following records, unless otherwise provided by law:
3
4 (iii) Personnel files except those files shall
5 be available to the duly elected and appointed officials
6 who supervise the work of the person in interest and as
7 otherwise provided in W.S. 9-1-704(m), 9-1-708(h) and
8 9-1-710(o). Applications, performance ratings and
9 scholastic achievement data shall be available only to the
10 person in interest and to the duly elected and appointed
11 officials who supervise his work. Employment contracts,
12 working agreements or other documents setting forth the
13 terms and conditions of employment of public officials and
14 employees are not considered part of a personnel file and
15 shall be available for public inspection;

17 Section 2. This act is effective July 1, 2023.
