Department of fire protection and electrical safety fees.

A BILL
for
1 AN ACT relating to fire protection and electrical safety;
2 amending fees collected by the department of fire
3 prevention and electrical safety; increasing fee limits for
4 specified fees; making a technical correction; requiring
5 rulemaking; and providing for effective dates.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 35-9-108(d) and (q)(i),
10 35-9-120(c)(intro), (i)(A) through (F) and (ii) and
11 35-9-129(a)(i) through (viii) and (x) are amended to read:

13 35-9-108. Plan review; procedure; fees.
14
15 (d) The department shall collect fees for plan
16 reviews and other inspections except as provided in

1 subsections (q) and (r) of this section, in the amount
2 provided in the 1997 Uniform Building Code and adjusted for
3 inflation as adopted established by rule or regulation by
4 of the department. Fees collected under this subsection
5 shall be deposited into the general fund.

7 (q) A plan review is:
8
9 (i) Not required for remodeling that is exempt
10 from permitting under the International Building Code;
11
12 35-9-120. Minimum requirements for electrical
13 installations; permits; inspections; fees.
14
15 (c) For any requested electrical inspection conducted
16 or electrical wiring permit issued by the chief electrical
17 inspector or his deputy, a fee established by the
18 department by rule shall be paid by the person or
19 contractor making the request. The electrical wiring permit
20 fee shall be waived included for anyone requesting and
21 paying for an electrical inspection. The fees established
22 by the department shall not exceed the following:

1 (i) Electrical inspection fees for requested
2 inspections:

4 (A) Each residential unit . . $20.00 $50.00
5 plus $.50 $1.10 per ampere rating of the electrical
6 service;

8 (B) Mobile home services . . .$20.00 $50.00
9 plus $.50 $1.10 per ampere rating of mobile home;

11 (C) Temporary services
12 . . . . . . . . . . . . $40.00 $90.00 each;

14 (D) Remodels of residential units

16 plus 2% of the value of any electrical installation
17 included in the remodel $1.10 per ampere rating of the

10 (a) The fees for licenses, work permits, examinations
11 and apprentice registrations shall be determined by the
12 department but shall not exceed:

19 Section 2. W.S. 35-9-129(a)(ix) is repealed.

21 Section 3. The department of fire prevention and
22 electrical safety shall promulgate any rules necessary to
23 implement the provisions this act.

2 Section 4.

4 (a) Except as provided in subsection (b) of this
5 section, this act is effective July 1, 2023.
6
7 (b) Sections 3 and 4 of this act are effective
8 immediately upon completion of all acts necessary for a
9 bill to become law as provided by Article 4, Section 8 of
10 the Wyoming Constitution.
