Trespass-removal of trespasser.

A BILL
for
1 AN ACT relating to crimes and offenses; providing for the
2 use of physical force against a trespasser as specified;
3 and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section 1. W.S. 6-3-303 by creating new subsections
8 (d) and (e) is amended to read:
9
10 6-3-303. Criminal trespass; penalties; justification.
11
12 (d) A person who is the owner or legal occupant of
13 land or a premises upon which a criminal trespass is
14 occurring, or their agent, is justified in using reasonable
15 and appropriate physical force upon another person when and

1 to the extent that it is reasonably necessary to terminate
2 what the owner, occupant or agent reasonably believes to be
3 the commission of a criminal trespass by the other person
4 in or upon the land or premises.

6 (e) Section (d) of this section does not supersede or
7 add to the responsibilities applicable to the defense of
8 self or another as provided by law.

10 Section 2. This act is effective July 1, 2023.
