The bill amends W.S. 37-2-205 by adding a new subsection (k) that establishes requirements for public utilities regarding service provision to customers located within another utility's certificated service territory. Specifically, it mandates that no public utility may provide service, either directly or indirectly, to a customer in another utility's territory without a customer allocation agreement in place between the customer and both utilities involved. This includes scenarios where service is provided to a delivery point outside the other utility's territory for consumption within it.
Additionally, the bill grants the aggrieved public utility the right to pursue a civil action for damages resulting from violations of this provision, allowing them to recover lost income due to unlawful service provision, as well as attorney fees and expenses incurred in enforcing their rights. The act is set to take effect on July 1, 2023.
