Abortion amendments.

A BILL
for
1 AN ACT relating to abortion; specifying that no abortion
2 shall be performed after the fetus has reached viability;
3 providing exceptions; clarifying the prohibition of the use
4 of appropriated funds for abortion; repealing conflicting
5 provisions; and providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section 1. W.S. 35-6-102 by creating a new subsection
10 (d) and 35-6-117 by creating a new subsection (c) are
11 amended to read:

13 35-6-102. Abortion restrictions; exception.

1 (d) An abortion shall not be performed after the
2 embryo or fetus has reached viability except when necessary
3 to preserve the woman from an imminent peril that
4 substantially endangers her life or health, according to
5 appropriate medical judgment, or if the pregnancy is the
6 result of incest as defined by W.S. 6-4-402 or sexual
7 assault as defined by W.S. 6-2-301.

9 35-6-117. Use of appropriated funds for abortion
10 prohibited; exceptions.

12 (c) No funds appropriated by the legislature of the
13 state of Wyoming shall be used to pay for abortions except
14 when the pregnancy is the result of incest as defined by
15 W.S. 6-4-402 or sexual assault as defined by W.S. 6-2-301
16 if the assault is reported to a law enforcement agency
17 within five (5) days after the assault or within five (5)
18 days after the time the victim is capable of reporting the
19 assault, or when the life of the mother would be endangered
20 if the unborn child was carried to full term.

22 Section 2. W.S. 35-6-102(b) and (c) and 35-6-117(b)
23 are repealed.

2 Section 3. This act is effective immediately upon
3 completion of all acts necessary for a bill to become law
4 as provided by Article 4, Section 8 of the Wyoming
5 Constitution.
