Traffic stops-probable cause.

A BILL
for
1 AN ACT relating to motor vehicles; prohibiting law
2 enforcement officers from requesting that vehicle occupants
3 exit vehicles as specified; providing exceptions; and
4 providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 31-5-1215 is created to read:
9
10 31-5-1215. Peace officer protocol for traffic stops.
11
12 (a) A peace officer, as defined by W.S.
13 7-2-101(a)(iv), shall not request that the driver or
14 occupant of a vehicle exit the vehicle during a traffic
15 stop unless:

2 (i) The peace officer has probable cause to
3 believe that the driver or occupant of the vehicle is
4 committing, or fleeing the scene of, a crime that is
5 punishable by imprisonment or that the driver or occupant
6 may be arrested pursuant to W.S. 7-20-102;

8 (ii) The peace officer has been notified of a
9 search warrant for the vehicle or that a warrant has been
10 issued for the arrest of the driver or occupant of the
11 vehicle;
12
13 (iii) The peace officer has been notified that
14 the driver or occupant of the vehicle has committed a crime
15 outside the state pursuant to the requirements of W.S.
16 7-3-214; or
17
18 (iv) The driver or occupant of the vehicle is in
19 immediate danger of bodily harm if they remain in the
20 vehicle.

22 (b) If a peace officer violates this section, any
23 evidence of a crime discovered pursuant to the violation

1 shall be suppressed in any subsequent criminal proceeding
2 against the driver or occupant of the vehicle.

4 Section 2. This act is effective July 1, 2023.
