A BILL
for
1 AN ACT relating to higher education scholarships and grant
2 programs; modifying the award of Wyoming's tomorrow
3 scholarships to include a preference for students enrolled
4 in credential programs approved by the Wyoming community
5 college commission under the Wyoming works program and
6 students enrolled in teacher preparation courses; modifying
7 the calculation of the average market value of the
8 Wyoming's tomorrow scholarship endowment fund as specified;
9 transferring funds; appropriating funds upon receipt of
10 matching private funds as specified; and providing for an
11 effective date.

13 Be It Enacted by the Legislature of the State of Wyoming:

1 Section 1. W.S. 21-16-1902(c) and 21-16-1905(b) are
2 amended to read:

4 21-16-1902. Wyoming's tomorrow scholarship
5 expenditure account created; use and appropriation of
6 funds; calculation of annual average market value.

8 (c) The annual average market value of the Wyoming's
9 tomorrow scholarship endowment fund shall be calculated as
10 follows for the fiscal year (FY) specified:
11
12 (i) FY 2023 2024 shall be equal to the market
13 value of the Wyoming's tomorrow scholarship endowment fund,
14 calculated from the first business day of the fiscal year;
15
16 (ii) FY 2024 2025 shall be equal to the previous
17 two (2) year average market value of the Wyoming's tomorrow
18 scholarship endowment fund, calculated from the first
19 business day of the fiscal year;

21 (iii) FY 2025 2026 shall be equal to the
22 previous three (3) year average market value of the

1 Wyoming's tomorrow scholarship endowment fund, calculated
2 from the first business day of the fiscal year;

4 (iv) FY 2026 2027 shall be equal to the previous
5 four (4) year average market value of the Wyoming's
6 tomorrow scholarship endowment fund, calculated from the
7 first business day of the fiscal year;

9 (v) FY 2027 2028 and each fiscal year
10 thereafter, shall be equal to the previous five (5) year
11 average market value of the Wyoming's tomorrow scholarship
12 endowment fund, calculated from the first business day of
13 the fiscal year.

15 21-16-1905. Administration; rules and regulations.

17 (b) The commission shall promulgate rules necessary
18 to implement this article in consultation with the
19 University of Wyoming, the department of workforce
20 services, the Wyoming business council and other
21 stakeholders, including industry representatives. The rules
22 shall provide for a preference to award scholarships which
23 considers workforce shortages and economic development

1 needs of the communities, regions and the state. First
2 preference shall be given to students who received a
3 scholarship under this article in the immediately preceding
4 academic term and remain eligible to receive a scholarship
5 under W.S. 21-16-1904(c). Second preference shall be given
6 to students who have secured an industry sponsorship. Third
7 preference shall be given to students enrolled in
8 credential programs approved by the commission under the
9 Wyoming works program pursuant to W.S. 21-18-407(b)(ii).
10 Fourth preference shall be given to students enrolled in
11 teacher preparation programs. Preference may be given to
12 students based on the length of their Wyoming residency.
13 Preference may be given to students without a degree.

15 Section 2.

17 (a) On July 1, 2023, the state auditor shall transfer
18 seventy-five million dollars ($75,000,000.00) from the
19 general fund to the Wyoming's tomorrow scholarship
20 endowment fund created by W.S. 9-4-204(u)(ix).

22 (b) There is appropriated to the Wyoming's tomorrow
23 scholarship endowment fund five million dollars

1 ($5,000,000.00) from the general fund, conditioned upon a
2 match of funds in the ratio of one dollar ($1.00) of
3 appropriated general fund to not less than one dollar
4 ($1.00) of matching funds from any private or nonpublic
5 funding source.

7 (c) The state treasurer shall deposit all private or
8 nonpublic funds received and state matching funds as
9 provided under subsection (b) of this section in the
10 Wyoming's tomorrow scholarship endowment fund. The state
11 treasurer shall make transfers pursuant to this subsection
12 from the general fund to the Wyoming's tomorrow scholarship
13 endowment fund not later than the end of the calendar
14 quarter following any quarter during which private or
15 nonpublic funds are received.

17 (d) On July 1, 2023, the state auditor shall transfer
18 fifteen million dollars ($15,000,000.00) from the general
19 fund to the Wyoming works program account created by W.S.
20 21-18-408(a).

22 (e) On July 1, 2023, the state auditor shall transfer
23 five million dollars ($5,000,000.00) from the general fund

1 to the Wyoming works student grant account created by W.S.
2 21-18-408(b).
