Protection of parental rights.

A BILL
for
1 AN ACT relating to parental rights; specifying
2 applicability of parental rights protections; and providing
3 for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section 1. W.S. 14-2-206 by creating a new subsection
8 (c), 20-5-501 and 21-2-101 are amended to read:
9
10 14-2-206. Protection of parental rights;
11 applicability.

13 (c) The parental right as provided under this section
14 shall also apply:

1 (i) In any judicial proceeding, determination or
2 other adjudication regarding parental rights involving
3 parentage, neglect, the termination of parental rights,
4 child custody or visitation under this title or under title
5 20 of the Wyoming statutes;

7 (ii) To any state or local educational agency,
8 school district, board of trustees, commission or school
9 under title 21 of the Wyoming statutes regarding
10 communication or disclosure to a parent about that parent's
11 child.

13 20-5-501. Application and construction; protection of
14 parental rights.

16 (a) In applying and construing this act,
17 consideration shall be given to the need to promote
18 uniformity of the law with respect to its subject matter
19 among states that enact it.

21 (b) The parental rights protections under W.S.
22 14-2-206 shall apply in any judicial proceeding,
23 determination or other adjudication regarding parental

1 rights involving parentage, neglect, the termination of
2 parental rights, child custody or visitation under this
3 title.

5 21-2-101. Application of Wyoming Administrative
6 Procedure Act; protection of parental rights.

8 (a) The Wyoming Administrative Procedure Act shall
9 apply to this code and no hearing shall be held or
10 adjudications made except in compliance with its
11 provisions.

13 (b) The parental rights protections under W.S.
14 14-2-206 shall apply to this code regarding any
15 communication or disclosure to a parent about that parent's
16 child.

18 Section 2. This act is effective July 1, 2023.
