Upper payment limit authorization.

A BILL
for
1 AN ACT relating to medical assistance and services;
2 authorizing the department of health to pursue an upper
3 payment limit supplemental payment program for the benefit
4 of psychiatric residential treatment facilities;
5 authorizing appropriations; and providing for an effective
6 date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. The department of health is authorized to
11 pursue an upper payment limit supplemental payment program
12 with the centers for Medicare and Medicaid services to
13 benefit psychiatric residential treatment facilities
14 (PRTFs) enrolled in Wyoming Medicaid and located in the
15 state of Wyoming. It is the intent of the legislature that

1 the department of health have authority to collect private
2 hospital assessments as specified in the Private Hospital
3 Assessment Act under W.S. 42-9-101 through 42-9-109 and use
4 these funds to secure federal matching funds available
5 through the state Medicaid plan for the benefit of PRTFs.

7 Section 2. There is appropriated three million eight
8 hundred fifty thousand dollars ($3,850,000.00) from other
9 funds and three million eight hundred fifty thousand
10 dollars ($3,850,000.00) from federal funds to the
11 department of health for the purpose of including PRTFs
12 under the Private Hospital Assessment Act under W.S.
13 42-9-101 through 42-9-109 for the period beginning July 1,
14 2023 and ending June 30, 2024. This appropriation shall not
15 be transferred or expended for any other purpose and any
16 unexpended, unobligated funds remaining from this
17 appropriation on June 30, 2024 shall revert as provided by
18 law. It is the intent of the legislature that this
19 appropriation not be included in the department of health's
20 standard budget request for the immediately succeeding
21 fiscal biennium. It is the intent of the legislature that
22 the department of health submit an exception request to

1 fund this program from federal funds and other funds for
2 the immediately succeeding fiscal biennium.

4 Section 3. This act is effective immediately upon
5 completion of all acts necessary for a bill to become law
6 as provided by Article 4, Section 8 of the Wyoming
7 Constitution.
