A BILL
for
1 AN ACT relating to elections; clarifying that specified
2 election records are not subject to disclosure under the
3 Wyoming Public Records Act; and providing for an effective
4 date.

6 Be It Enacted by the Legislature of the State of Wyoming:

8 Section 1. W.S. 22-2-113(d) is amended to read:
9
10 22-2-113. Availability and form of registry lists;
11 use of copies; election record; purging.

13 (d) Unless otherwise specifically stated in this
14 Election Code, all election records of the county clerk are
15 public. The availability and dissemination of such records

1 shall be in accordance with the Wyoming Public Records Act.
2 Election records containing social security numbers,
3 portions of social security numbers, driver's license
4 numbers, birth dates, telephone numbers, tribal
5 identification card numbers, e-mail addresses, cast
6 ballots, cast ballot images, cast vote records of
7 individual voters, other data derived from cast ballots of
8 individual voters and other personally identifiable
9 information other than names, gender, addresses and party
10 affiliations are not public records and shall be kept
11 confidential. When necessary, members of the county or
12 state canvassing boards may access confidential information
13 for purposes of this code but shall maintain its
14 confidentiality.

16 Section 2. This act is effective July 1, 2023.
