State assessment of independent power producers.

A BILL
for
1 AN ACT relating to ad valorem taxation; clarifying that the
2 state is responsible for the valuation and assessment of
3 independent power producer property; requiring the release
4 of information to the county assessor; providing for
5 confidentiality of the valuation and assessment of
6 independent power producer property; requiring an agreement
7 for disclosure; and providing for an effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 39-13-102(m) by creating a new
12 paragraph (xi) and by creating a new subsection (r) is
13 amended to read:

15 39-13-102. Administration; confidentiality.

2 (m) The department shall annually value and assess
3 the following property at its fair market value for
4 taxation:
5
6 (xi) Property of independent power producers
7 operating facilities for the generation or transmission of
8 electricity for wholesale.

10 (r) The department shall upon written request provide
11 information related to the valuation and assessment of
12 property under W.S. 39-13-102(m)(xi) to the county assessor
13 of the county where the property is located for the purpose
14 of reviewing the valuation or information used in the
15 valuation. All information provided under this subsection
16 shall be confidential and no current or former official,
17 officer, employee or agent of the state of Wyoming or any
18 political subdivision thereof, including the county
19 assessor, shall disclose any information obtained under
20 this subsection. Any person receiving information under
21 this subsection shall sign an agreement with the department
22 to keep the information confidential.

1 Section 2. This act is effective immediately upon
2 completion of all acts necessary for a bill to become law
3 as provided by Article 4, Section 8 of the Wyoming
4 Constitution.
