A BILL
for
1 AN ACT relating to education; authorizing a board of
2 cooperative educational services to act as a local
3 education agency for the purpose of applying for and
4 receiving state and federal grants; authorizing rulemaking;
5 and providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 21-20-112 is created to read:
10
11 21-20-112. Authority to act as a local education
12 agency.

14 (a) Any board of cooperative educational services may
15 act as a local education agency for participating school

1 districts that choose to apply for, receive or administer a
2 grant through a grant program created by a federal or state
3 statute or program.

5 (b) A board of cooperative educational services may
6 apply to the department of education for federal or state
7 moneys received by the department only with the approval of
8 two (2) or more of the participating school districts that
9 have expressly agreed to participate in a grant application
10 through votes of the boards of trustees of the school
11 districts. If a board of cooperative educational services
12 applies for state or federal grant moneys on behalf of
13 participating school districts, the participating school
14 districts are not eligible to apply for the same state or
15 federal grant moneys. If a participating school district
16 does not elect to participate in a grant application, that
17 school district is not precluded from applying for the same
18 state or federal grant moneys as an individual school
19 district.

21 (c) The department shall treat boards of cooperative
22 educational services as local education agencies for
23 purposes of this section only and allow them to apply for

1 all federal and state grant moneys for which they are
2 eligible. The department may inform boards of cooperative
3 educational services of federal and state grant moneys for
4 which they may apply.

6 (d) An eligible grantee or consortium of grantees may
7 designate a board of cooperative educational services as
8 the fiscal manager for a state or federal grant. The
9 grantee or consortium of grantees remains responsible for
10 ensuring that all the requirements of the grant are met.

12 (e) The state superintendent of public instruction
13 may promulgate rules to establish processes and guidelines
14 for a board of cooperative educational services to apply
15 for state or federal grant moneys pursuant to this section.

17 Section 2. This act is effective immediately upon
18 completion of all acts necessary for a bill to become law
19 as provided by Article 4, Section 8 of the Wyoming
20 Constitution.
