A BILL
for
1 AN ACT relating to taxation and revenue; changing
2 distribution of a percentage of severance tax from the
3 permanent Wyoming mineral trust fund and common school
4 account to the highway fund and the community college
5 commission; and providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section 1. W.S. 39-14-801(b)(v) is amended to read:
10
11 39-14-801. Severance tax distributions; distribution
12 account created; formula.

14 (b) Before making distributions from the severance
15 tax distribution account under subsections (c) through (e)

1 of this section, an amount equal to two-thirds (2/3) of the
2 amount of tax collected under W.S. 39-14-104(a)(i) and
3 (b)(i) and 39-14-204(a)(i) for the same period shall be
4 deposited as follows:

6 (v) For fiscal year 2023 through fiscal year
7 2028 and thereafter, these funds shall be deposited equally
8 to the permanent Wyoming mineral trust fund and to the
9 common school account within the permanent land fund;
10 seventy percent (70%) to the highway fund and thirty
11 percent (30%) to a separate account that is continuously
12 appropriated for and may be expended by the community
13 college commission in accordance with and in addition to
14 appropriations available under W.S. 21-18-205(c).

16 Section 2. W.S. 39-14-801(b)(vi) and (f) is repealed.

18 Section 3. This act is effective July 1, 2022.
