A BILL
for
1 AN ACT relating to the Hathaway scholarship program;
2 amending award timing for the Hathaway scholarship program;
3 amending eligibility requirements as specified; amending
4 the calculation of unmet financial need; amending the
5 calculation of scholarship amounts; deleting obsolete
6 language; specifying applicability; repealing provisions;
7 and providing for an effective date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 21-16-1301(a)(i), (ii) and by
12 creating new paragraphs (xxi) and (xxii),
13 21-16-1303(b)(iii)(B) and (d), 21-16-1304(a)(i)(intro),
14 (ii)(intro), (iii)(intro) and (h)(intro),
15 21-16-1305(a)(i)(intro) and (e)(intro), 21-16-1306 by
16 creating a new subsection (c), 21-16-1307(b)(intro),

1 (d)(intro) and (e)(intro), 21-16-1308(b)(iii)(A) and
2 (iv)(A), 21-16-1309 by creating a new subsection (c),
3 21-16-1310, 21-16-1312(c) and 21-18-404 are amended to
4 read:

6 21-16-1301. Definitions.
7
8 (a) As used in this article:
9
10 (i) "Academic term" means the fall semester or
11 term, or the spring semester or term, the summer semester
12 or term or other term offered by an eligible institution.
13 In this article, "term" and "semester" have the same
14 meaning; except that recipients may elect to use the
15 scholarship during summer school, which except as provided
16 by W.S. 21-16-1304(h) and 21-16-1305(e), counts toward the
17 maximum number of terms for which the student is eligible
18 but does not count toward computation of an academic year;
19
20 (ii) "Academic year" means two (2) consecutive
21 fall and spring semesters. or terms and is the period of
22 time a full-time student is expected to complete the
23 equivalent of at least two (2) semesters of academic work

1 Unless otherwise excluded under this article, academic year
2 may also include summer term or other terms;

4 (xxi) "Remaining scholarship amount" means the
5 student's total scholarship amount less amounts previously
6 paid on behalf of the student from scholarships under W.S.
7 21-16-1304 or 21-16-1305;
8
9 (xxii) "Total scholarship amount" means the
10 dollar amount specified under W.S. 21-16-1304 or 21-16-1305
11 for the scholarship the student is first awarded under W.S.
12 21-16-1304 or 21-16-1305.

14 21-16-1303. Hathaway scholarship program; eligibility
15 requirements.

17 (b) Under the Hathaway scholarship program, subject
18 to availability of funds as determined by the legislature,
19 the state shall provide a scholarship pursuant to W.S.
20 21-16-1304 and 21-16-1305 to any student who has been
21 accepted by and enrolls in an eligible institution to
22 pursue a degree or certificate, and who meets the following
23 qualifications:

2 (iii) The student has:

4 (B) Applied for a scholarship under this
5 article within four (4) twenty (20) years of the date of
6 high school graduation, or is otherwise eligible under
7 rules promulgated pursuant to W.S. 21-16-1308(b)(iii) and
8 (iv). The department shall by rule and regulation establish
9 exceptions to the requirement of this subparagraph for
10 military service, religious service and other good cause
11 shown; and
12
13 (d) No student shall be eligible for a scholarship
14 under this article for more than the equivalent of eight
15 (8) full-time semesters. Except as provided by subsection
16 (f) of this section, no student shall be eligible for a
17 scholarship under this article for any semesters commencing
18 after six (6) twenty (20) academic years following the
19 student's initial eligibility. For purposes of this
20 subsection, a student's initial eligibility shall be deemed
21 to commence with the first semester in which the state is
22 obligated to reimburse an eligible institution for the
23 student's scholarship under this article be the date of the

1 eligible student's high school graduation. The department
2 shall by rule and regulation establish exceptions to this
3 subsection for military service, religious service and
4 other good cause shown.

6 21-16-1304. Hathaway opportunity, performance and
7 honor scholarships.
8
9 (a) Any student who meets the criteria under W.S.
10 21-16-1303 is eligible to receive a scholarship to pursue a
11 degree or certificate as follows:
12
13 (i) With a minimum cumulative high school GPA of
14 2.50 and a score equal to or greater than the 2015-2016
15 national percentile rank of forty-three (43) on a college
16 entrance examination administered throughout the United
17 States and relied upon by institutions of higher education
18 to determine acceptance of students for attendance, a
19 Hathaway opportunity scholarship for: in a total
20 scholarship amount of six thousand seven hundred twenty
21 dollars ($6,720.00).

1 (ii) With a minimum cumulative high school GPA
2 of 3.0 and a score equal to or greater than the 2015-2016
3 national percentile rank of fifty-six (56) on a college
4 entrance examination administered throughout the United
5 States and relied upon by institutions of higher education
6 to determine acceptance of students for attendance, a
7 Hathaway performance scholarship for: in a total
8 scholarship amount of ten thousand eighty dollars
9 ($10,080.00).

11 (iii) With a minimum cumulative high school GPA
12 of 3.5 and a score equal to or greater than the 2015-2016
13 national percentile rank of seventy-nine (79) on an
14 examination administered throughout the United States and
15 relied upon by institutions of higher education to
16 determine acceptance of students for attendance, a Hathaway
17 honor scholarship for: in a total scholarship amount of
18 thirteen thousand four hundred forty dollars ($13,440.00).

20 (h) Notwithstanding subparagraphs (a)(i)(B), (ii)(B)
21 and (iii)(B) of this section, The applicable scholarship
22 amount awarded to any eligible student under this section
23 may be available to that student, upon election, for

1 enrollment in up to six (6) semester hours during any
2 summer academic term or other academic term offered by an
3 eligible institution outside of the regular fall or spring
4 semester., subject to the following:
5
6 21-16-1305. Hathaway provisional opportunity
7 scholarships.
8
9 (a) Any student who meets the criteria under W.S.
10 21-16-1303 is eligible to receive a Hathaway provisional
11 opportunity scholarship to pursue a certificate or degree
12 as follows:
13
14 (i) With a minimum cumulative high school GPA of
15 2.50 and either a score equal to or greater than the
16 2015-2016 national percentile rank of thirty (30) on a
17 college entrance examination administered throughout the
18 United States and relied upon by institutions of higher
19 education to determine acceptance of students for
20 attendance or a qualifying cumulative score on a
21 career-technical aptitude test as determined by the
22 department, a scholarship for: in a total scholarship

1 amount of three thousand three hundred sixty dollars
2 ($3,360.00).

4 (e) Notwithstanding subparagraph (a)(i)(B) of this
5 section, The scholarship amount awarded to any eligible
6 student under this section may be available to that
7 student, upon election, for enrollment in up to six (6)
8 semester hours during any summer academic term or other
9 academic term offered by an eligible institution outside of
10 the regular fall or spring semester., subject to the
11 following:
12
13 21-16-1306. Need based scholarships.
14
15 (c) Except as provided in this subsection, no student
16 shall be required by the eligible institution to elect to
17 use a greater portion of a scholarship awarded under W.S.
18 21-16-1304 or 21-16-1305 in order to decrease the student's
19 unmet financial need. For scholarships awarded under W.S.
20 21-16-1304 and 21-16-1305 the calculation of unmet
21 financial need shall be in accordance with the following:

1 (i) For students receiving the Hathaway honors
2 scholarship, the scholarship amount used to calculate unmet
3 financial need shall be:
4
5 (A) One thousand six hundred eighty dollars
6 ($1,680.00) per semester; or
7
8 (B) The amount provided under subparagraph
9 (A) of this paragraph times a fraction, the numerator of
10 which is the number of hours for which the student is
11 enrolled per semester and the denominator is twelve (12),
12 if the student enrolled at an eligible institution for at
13 least six (6) and less than twelve (12) semester hours.

15 (ii) For students receiving the Hathaway
16 performance scholarship, the scholarship amount used to
17 calculate unmet financial need shall be the lesser of:
18
19 (A) The scholarship amount actually used by
20 the student in the semester; or
21
22 (B) One thousand two hundred sixty dollars
23 ($1,260.00) per semester.

2 (iii) For students receiving the Hathaway
3 opportunity scholarship, the scholarship amount to
4 calculate unmet financial need shall be the lesser of:
5
6 (A) The scholarship amount actually used by
7 the student in the semester; or
8
9 (B) Eight hundred forty dollars ($840.00)
10 per semester.

12 (iv) For students receiving the Hathaway
13 provisional opportunity scholarship, the scholarship amount
14 used to include of unmet financial need shall be the lesser
15 of:
16
17 (A) The scholarship amount actually used by
18 the student in the semester; or
19
20 (B) Eight hundred forty dollars ($840.00)
21 per semester.

23 21-16-1307. Success curriculum; test standards.

2 (b) Except as otherwise provided for by law, the
3 success curriculum required to qualify for honor or
4 performance scholarship eligibility under this article for
5 students graduating from high school in the 2019-2020
6 school year and each school year thereafter shall be as
7 follows:

9 (d) The success curriculum required to qualify for
10 opportunity scholarship eligibility under this article for
11 students graduating from high school in the 2010-2011
12 school year and each school year thereafter shall be as
13 follows:
14
15 (e) The success curriculum required to qualify for
16 provisional opportunity scholarship eligibility under this
17 article for students graduating from high school in the
18 2010-2011 school year and each school year thereafter shall
19 be the curriculum required for high school graduation under
20 W.S. 21-2-304(a)(iii) subject to the following:

22 21-16-1308. Administration and rules.

1 (b) The department shall, in consultation with
2 University of Wyoming and community college admissions
3 officers, the Wyoming community college commission and
4 financial aid officers and school districts, promulgate
5 rules and regulations necessary to implement this article,
6 including:
7
8 (iii) Criteria and procedures under which
9 students in a home-based educational program can qualify
10 for scholarships under this article. A student in a
11 home-based educational program:
12
13 (A) Shall make application for an initial
14 scholarship before his twenty-first forty-first birthday;
15
16 (iv) Criteria and procedures under which
17 students who receive a high school equivalency certificate
18 can qualify for scholarships under this article. A student
19 receiving a high school equivalency certificate shall:
20
21 (A) Receive the certificate and make
22 application for the initial scholarship no later than four
23 (4) twenty (20) years after and no sooner than the

1 graduation date of the student's high school class, unless
2 ordered by a court to complete the requirements for the
3 certificate prior to that graduation date or for other good
4 cause shown as determined by the department. For purposes
5 of making application prior to the graduation date of the
6 student's class, "other good cause" shall include, but is
7 not limited to, a showing by the student that the student
8 has been emancipated under W.S. 14-1-201 through 14-1-206
9 or that the student is a parent or a legal guardian of a
10 minor. The student shall have attended an eligible high
11 school prior to receiving his certificate and shall have
12 received his certificate while residing in Wyoming;
13
14 21-16-1309. Scholarship amounts.
15
16 (c) Any student receiving a scholarship under W.S
17 21-16-1304 or 21-16-1305 may elect to receive all or a
18 portion of his remaining scholarship amount in any semester
19 in which the student is enrolled at an eligible
20 institution. The election shall be submitted to the
21 eligible institution at the time of enrollment for an
22 academic term. The eligible institution shall calculate
23 the student's remaining scholarship amount in accordance

1 with W.S. 21-16-1301(a)(xxi) and shall include the amount,
2 as limited in this subsection, in its certification of
3 students under W.S. 21-16-1308. The department shall
4 review the amount certified for each student and include
5 the amount it determines to be in compliance with this
6 article in its certification to the state treasurer of
7 balances due to each institution under W.S.
8 21-16-1308(a)(v). Crediting of a student's remaining
9 scholarship amount under this subsection shall be limited
10 so that the remaining scholarship amount to be credited
11 does not exceed the cost of the student's tuition and
12 mandatory fee
