The bill amends the Code of West Virginia by adding a new section, 5-10-52a, to the Public Employees Retirement Act. It allows certain staff members employed at Hopemont Hospital, Jackie Withrow Hospital, John Manchin Sr. Health Care Center, and Lakin State Hospital to begin drawing their retirement benefits before the age of 60, provided they are 55 years old within one calendar year of October 31, 2025. These employees, who would otherwise qualify for retirement under the existing provisions, can access their retirement benefits early, with specific provisions for Tier 1 employees regarding unused sick leave.
Additionally, the bill clarifies that these employees will be considered to have retired directly from a participating employer in the Public Employees Insurance Agency, ensuring their eligibility for health insurance coverage in retirement. The commencement of retirement annuity benefits for eligible employees will begin on the first day of the month following the effective date of the section or upon reaching the age of 55, whichever is later. The bill is effective immediately upon passage.
