This bill amends West Virginia Code ยง17C-17-6 to exempt certain open top farm trucks, trailers, and other vehicles transporting hay, straw, silage, and other biodegradable products from the penalty provisions related to load security violations. The legislation acknowledges that during specific times of the year, farmers transport these products to other farms, and while these loads may occasionally escape, they do not pose significant environmental hazards. However, the exemption does not apply to vehicles carrying full bales or large portions of bales that could cause injury if they escape.
Additionally, the bill introduces provisions allowing the commissioner of the department of highways to establish speed limits for these vehicles, not exceeding 45 miles per hour, when transporting biodegradable farm products that are prone to blowing away. It also mandates that special permits be required for farm trucks, trailers, and other vehicles engaged in this type of transportation. The changes aim to facilitate agricultural operations while ensuring safety on the highways.
