The bill amends the Code of West Virginia by adding a new section, 18-20-13, which focuses on ensuring timely educational evaluations and continuity of services for children entering foster care or transition homes. It establishes a maximum initial evaluation period of 30 days for these children to receive Individualized Education Program (IEP) or 504 services.

Additionally, the bill mandates that when a student in the foster care system or a transition home transfers to a new school, the previous school must provide the new school with a copy of the student's current IEP or 504 Plan immediately upon transfer. The new school is then required to hold an IEP meeting or convene a Student Assistance Team (SAT) within five days of receiving the necessary documentation to ensure that the student's educational needs are promptly addressed.
