This bill amends the Code of West Virginia to include a new provision that prohibits the operation of unmanned aerial vehicles (UAVs) over polling places on election day. Specifically, it establishes that any person who knowingly and intentionally operates a UAV above the grounds of a polling place or within 100 feet of the entrance to the building housing the polling place is guilty of a misdemeanor. Upon conviction, the individual may face a fine ranging from $100 to $1,000, confinement in jail for up to one year, or both.
Additionally, the bill clarifies that individuals authorized by the Federal Aviation Administration (FAA) to operate UAVs for commercial purposes may continue to do so in West Virginia, provided their operations comply with federal law. This amendment aims to enhance the integrity of the electoral process by preventing potential disruptions or surveillance at polling locations during elections.
