This bill aims to enhance the integrity of electronic voting systems in West Virginia by introducing a new section, 3-4A-13a, which mandates inspections of precinct tabulating equipment by county commissions and audits by the Secretary of State. The inspections must occur no later than one week before the in-person voting period, ensuring that all tabulating equipment is independent, non-networked, and free from any internet connectivity. The county commissions are required to submit detailed reports of their findings, including verification that no modems or SIM cards are installed in the tabulators, and that each tabulator is sealed for the election after inspection.
Additionally, the Secretary of State is tasked with conducting a pre-election audit of at least 10 percent of the precinct tabulating equipment in a minimum of five randomly selected counties, at least 14 days before election day. The audit will also require comprehensive reporting similar to that of the county commissions, ensuring transparency and compliance with state law. Any tabulation equipment found to be noncompliant cannot be used in elections until confirmed compliant by the Secretary of State. This bill emphasizes the importance of maintaining secure and reliable voting systems in the state.
