This bill amends the Code of West Virginia to authorize county courts to establish County Parks, Entertainment, and Recreation Commissions (PERCs). The new legal language specifies that these commissions are responsible for the establishment, improvement, development, administration, operation, and maintenance of county public parks and recreational facilities. Additionally, it allows for the creation of a PERC unless a county demonstrates fiscal inability or already has an established parks and recreation board or commission.

The bill also modifies the composition and appointment process of the commission. It changes the number of members from a fixed eleven to an odd number determined by the county commission based on the county's population. The terms of the members will still be three years, but the initial appointments will be for varying terms of one, two, and three years, as determined by the county court. Furthermore, it clarifies that any member who ceases to be a bona fide resident or freeholder of the county will be disqualified, and the process for filling vacancies is outlined.
