The bill amends the West Virginia Real Estate License Act, specifically section 30-40-6, to update the membership qualifications and appointment process for the West Virginia Real Estate Commission. The commission will continue to consist of five members appointed by the Governor with Senate approval, with four members required to be licensed real estate professionals and one a non-licensed citizen member. The qualifications for licensed commissioners have been modified to require a minimum of 10 years of experience in the real estate field immediately preceding their appointment, and they must have been residents of West Virginia for at least six years prior to their appointment.

Additionally, the bill changes the appointment process for the licensed commissioners. The Governor will now appoint three of the four licensed commissioners directly, while the fourth will be selected from three nominees provided by the West Virginia Association of Realtors. The bill also clarifies the conditions under which a commissioner may forfeit their position and outlines the removal process by the Governor. Other provisions regarding term limits, compensation, and quorum requirements remain largely unchanged.
