The bill outlines that a racing facility or racetrack built before a surrounding property owner acquired their property cannot be subject to civil actions based on nuisance or other claims, regardless of any lawful changes made to the facility thereafter.

Additionally, the bill preempts local governments from enacting ordinances that would restrict or prohibit the operation of racing facilities in a manner inconsistent with the provisions of this article. The legislation is designed to protect existing racetracks from legal challenges by property owners who move into the vicinity after the racetracks have been established. The bill is set to take effect immediately upon passage.
