The West Virginia Clean Air in Schools Act of 2026 aims to improve indoor air quality (IAQ) in K-12 schools across the state. The bill introduces a new article to the Code of West Virginia, which includes definitions of key terms related to indoor air quality, such as IAQ monitors, particulate matter, and volatile organic compounds. It establishes a public dashboard for monitoring IAQ data and mandates the development of corrective action plans for schools that exceed health standards.
The implementation of the Act is structured in three phases, with specific deadlines for each phase. By July 1, 2027, IAQ monitors must be installed in all elementary school classrooms, and a public dashboard must be operational. The second phase, by July 1, 2028, requires the installation of monitors in 50% of middle and high school classrooms, with a focus on special education and vulnerable areas. Finally, by July 1, 2029, all remaining classrooms must have monitors, and schools must comply with health standards for various pollutants. Schools with repeated exceedances will need to submit corrective action plans until compliance is achieved.
