This bill proposes the addition of a new section, 9-5-34, to the Code of West Virginia, which mandates that the Department of Human Services reimburse remote ultrasound procedures and remote fetal nonstress tests. These reimbursements will utilize established CPT codes and apply when patients are located in their residences or other off-site locations, provided that the same standard of care is maintained. The bill outlines specific conditions under which these procedures are reimbursable, including the requirement for providers to use digital technology to securely collect and transmit health data, compliance with federal health regulations, and FDA approval for the technology used.

Additionally, the bill specifies that reimbursement for fetal nonstress tests (CPT Code 59025) is contingent upon the use of FDA-cleared remote monitoring solutions for at-home monitoring of fetal and maternal heart rates and uterine activity. The Department of Human Services is also tasked with issuing guidance for the implementation of this section and will not require a minimum of 30 days between informed consent and the performance of these remote procedures.
