This bill aims to amend the Code of West Virginia by removing the existing prohibition against establishing additional all-terrain vehicle (ATV), off-highway recreational vehicle (ORV), and utility-terrain vehicle (UTV) trail systems within state parks and state forests. Specifically, it deletes the language that currently restricts the Parks and Recreation Section of the Division of Natural Resources from creating new trail systems, while also allowing for the development and use of connector trails from private systems to facilitate access to recreational facilities.
Additionally, the bill maintains the authority of the Director of the Division of Natural Resources to establish special permits for ATV and ORV users, as well as to close certain areas to public use. It also empowers the Director to promulgate necessary emergency legislative rules to implement the provisions of this section effectively.
