This bill proposes the addition of a new section, 3-4A-13a, to the Code of West Virginia, focusing on the inspection and auditing of electronic voting systems. It mandates that county commissions inspect all precinct tabulating equipment at least one week before the in-person voting period to ensure compliance with state laws prohibiting internet connectivity. The inspections must verify that no modems or SIM cards are installed in the tabulators, and that each tabulator is sealed immediately after inspection. The county commissions are required to submit a detailed report of their findings to the Secretary of State on the day of the inspection.
Additionally, the bill requires the Secretary of State to conduct a pre-election audit of at least 10 percent of the precinct tabulating equipment in a minimum of five randomly selected counties, no later than 14 days before election day. The audit must also confirm the absence of modems and SIM cards, and that the tabulators are sealed. A report of the audit findings will be prepared and made available for public inspection, including necessary actions to address any identified noncompliance. This legislation aims to enhance the integrity of the electoral process by ensuring that all voting equipment adheres to state regulations regarding internet connectivity.
