This bill amends the Code of West Virginia by adding a new section, 3-4A-13a, which establishes requirements for the inspection and auditing of electronic voting systems. It mandates that county commissions inspect all precinct tabulating equipment at least one week before the in-person voting period to ensure compliance with state laws prohibiting internet connectivity. The county commissions are required to submit detailed reports of their findings to the Secretary of State, including verification that no modems or SIM cards are installed in the tabulators, that the equipment is sealed for the election, and any actions taken to address identified issues.

Additionally, the Secretary of State is tasked with conducting a pre-election audit of at least 10 percent of the precinct tabulating equipment in a minimum of five randomly selected counties, ensuring compliance with the same connectivity prohibitions. The Secretary must also prepare a public report of the audit findings. Furthermore, the bill includes a provision for the Secretary of State to monitor technological advancements and potential vulnerabilities related to voting equipment, advising the Joint Committee on Government and Finance of any emerging threats at least annually.
