This bill amends the Code of West Virginia to authorize the Division of Motor Vehicles (DMV) to obtain and issue certified copies of vital records, such as birth, death, marriage, and divorce certificates, for U.S. citizens. Starting July 1, 2025, the DMV will be required to confirm the applicant's U.S. citizenship by verifying one of four approved documents, including a valid birth certificate or U.S. passport. The DMV will also be required to adhere to the rules set forth by the State Registrar and will collect a minimum fee of $12 for each vital record issued, which will be transmitted to the State Registrar monthly to cover associated costs.

Additionally, the bill establishes a new section that mandates the Commissioner of the DMV and the Secretary of the Department of Health to enter into a Memorandum of Understanding. This agreement will outline the development and implementation of a program that allows the DMV to access electronic vital records while ensuring the integrity and security of these records. The Memorandum will also include provisions for confirming U.S. citizenship, audit requirements, and training for DMV staff on the proper methods for issuing certified copies and verifying requester eligibility.
