The bill amends sections 17-4-8 and 31-2A-2 of the Code of West Virginia to enhance regulations regarding the use of state roads for rail crossings. It establishes that railroad companies may construct or maintain their tracks on state roads only under specific restrictions set by the Division of Highways. Additionally, the bill mandates that railroad companies are responsible for keeping their roadbeds and the state road at crossings in proper repair, and they must construct overhead or undergrade crossings if necessary. A new requirement is introduced for the Division of Highways to create a memorandum of understanding with each operating railway company to coordinate road closures, ensuring minimal disruption to the public.

Furthermore, the bill addresses the issue of blocked crossings by prohibiting railroad companies from allowing trains to block vehicular traffic for more than ten minutes, except in emergencies. It also stipulates that if a railroad company closes a state road for maintenance or construction lasting over twenty-four hours, they must provide a temporary alternate entry and exit for emergency medical service vehicles. This provision aims to safeguard public health and ensure access for residents and emergency services during such closures.
