The bill amends West Virginia's Code, specifically section 50-2-1, to increase the jurisdictional limits of magistrate courts in civil actions. Under the new provisions, magistrate courts will have jurisdiction over civil actions where the value or amount in controversy does not exceed $20,000. This includes matters related to unlawful entry or detainer of real property, provided that the title to the property is not in dispute. The bill also clarifies that magistrate courts will continue to have jurisdiction over post-judgment motions and that certain provisions regarding unlawful entry and detainer will apply to actions in magistrate court.

Additionally, the bill outlines the authority of magistrates and court clerks, allowing them to administer oaths, take affidavits or depositions, and acknowledge deeds and other writings, unless otherwise specified by law. However, it maintains that magistrate courts do not have jurisdiction over specific matters, including actions in equity, eminent domain, and cases involving the title to real estate, among others. The changes are set to take effect 90 days after passage, on July 7, 2025.
