The proposed bill introduces the "Truth in Giving Act" to the Code of West Virginia, establishing new requirements for thrift operators regarding the disclosure of information to donors and customers. It mandates that thrift operators, whether charitable organizations or for-profit businesses, provide clear information about the nature of their operations. Specifically, charitable organizations must disclose their name, address, and contact information, while for-profit entities must inform donors that their donations support a for-profit business. This information must be prominently displayed on drop boxes, at donation sites, and at points of sale.
Additionally, the bill empowers the Secretary of State to investigate violations of these disclosure requirements and establishes both criminal and civil penalties for non-compliance. Offenders may face fines or imprisonment, depending on the severity of the violation. The bill also stipulates that any recovered funds from penalties will be split between the state General Revenue Fund and the Secretary of State's operational account. Furthermore, the Secretary of State is authorized to propose rules to implement the provisions of the act effectively.
