This bill amends the Code of West Virginia to authorize the Department of Environmental Protection (DEP) to promulgate a legislative rule concerning underground injection control. Specifically, it addresses the duration of permits for various classes of underground injection control (UIC) wells. The bill establishes that UIC permits for Class 1 and 5 wells will be effective for a maximum of 10 years, while permits for Class 2 and 3 wells will be issued for the operating life of the facility. Additionally, permits for Class 6 wells will cover both the operating life of the facility and the post-injection site care period.

Furthermore, the bill mandates that the Director of the DEP must review each issued Class 2, 3, and 6 well UIC permit at least once every five years to assess whether modifications, revocation, termination, or minor modifications are necessary. This legislative change aims to enhance the regulatory framework surrounding underground injection control, ensuring that permits are appropriately managed and reviewed over time.
