This bill amends and reenacts section 64-3-1 of the Code of West Virginia, 1931, to authorize the Department of Environmental Protection (DEP) to promulgate a legislative rule concerning underground injection control. Specifically, it addresses the duration of permits for various classes of underground injection control (UIC) wells. The bill establishes that UIC permits for Class 1 and 5 wells will be valid for a maximum of 10 years, while permits for Class 2 and 3 wells will be issued for the operational lifespan of the facility. Additionally, Class 6 well permits will cover both the operational life and the post-injection site care period.

The bill also mandates that the Director of the DEP must review each issued Class 2, 3, and 6 well UIC permit at least once every five years to assess whether modifications, revocations, terminations, or minor adjustments are necessary. This legislative change aims to enhance the regulatory framework surrounding underground injection control, ensuring that permits are appropriately managed and reviewed over time.
