This bill proposes the addition of a new section, 4-1-24, to the Code of West Virginia, which mandates random drug testing for legislators during each regular session of the legislature. The Legislative Manager is tasked with establishing a program that includes procedures for random testing, ensuring that no legislator is tested more than twice per session, and administering the tests efficiently.

Furthermore, if a legislator's initial test indicates illegal drug use, they must undergo a second test within 30 to 60 days. Should the second test also indicate illegal drug use or if the legislator fails to participate in the testing program, this information will be made public. The bill also emphasizes the confidentiality of all drug test results, except in cases where public disclosure is required.
