This bill proposes the addition of a new section, designated as 61-3-60, to the Code of West Virginia, which addresses the damage, destruction, or theft of property or equipment utilized by first responders. It establishes that any individual who knowingly and willfully damages, destroys, or steals such equipment—whether in use or stored—creates a substantial risk of bodily injury, property loss, or interruption of service by first responders will be guilty of a felony. Upon conviction, the penalties include a fine of up to $5,000, imprisonment for a term of one to three years, or both.
Additionally, the bill defines "first responders" to encompass law enforcement officers, firefighters, emergency medical services personnel, and volunteer fire departments, among others who respond to emergency medical assistance calls. The intent of this legislation is to enhance the protection of first responders' equipment and ensure accountability for actions that jeopardize public safety and emergency services.
