1 AN ACT supplementing and amending the appropriations of public moneys out of the Treasury
2 from the balance of moneys remaining as an unappropriated surplus balance in the State
3 Fund, General Revenue, to the Department of Administration, Public Employees
4 Insurance Agency, fund 0200, fiscal year 2025, organization 0225, by supplementing and
5 amending Chapter 11, Acts of the Legislature, Regular Session, 2024, known as the
6 budget bill for the fiscal year ending June 30, 2025.
1 WHEREAS, The Governor submitted the Executive Budget Document to the Legislature
2 on January 10, 2024, containing a statement of the State Fund, General Revenue, setting forth
3 therein the cash balance as of July 1, 2023, and further included the estimate of revenue for the
4 fiscal year 2024, less net appropriation balances forwarded and regular and surplus
5 appropriations for the fiscal year 2024, and further included recommended expirations to the
6 unappropriated surplus balance of the State Fund, General Revenue; and
1 WHEREAS, The Governor submitted to the Legislature an Executive Message dated May
2 19, 2024, which included a revised estimate of revenues for the State Fund, General Revenue,
3 and recommended supplementary appropriations for the fiscal year 2024; and
1 WHEREAS, The Governor submitted to the Legislature an Executive Message dated
2 September 30, 2024, which included a statement of the State Fund, General Revenue, setting
3 forth therein the cash balance as of July 1, 2024, and further included the estimate of revenue for
4 the fiscal year 2025, less net appropriation balances forwarded and regular and surplus
5 appropriations for the fiscal year 2025; and
1 WHEREAS, It appears from the Executive Message, Statement of the State Fund, General
2 Revenue, there remains an unappropriated surplus balance in the State Treasury which is
3 available for appropriation during the fiscal year ending June 30, 2025; therefore Be it enacted by the Legislature of West Virginia:

1 That Chapter 11, Acts of the Legislature, Regular Session, 2024, known as the budget bill
2 to fund 0200, fiscal year 2025, organization 0225, be supplemented and amended to insert a new
3 item of appropriation as follows:
4 TITLE II – APPROPRIATIONS.

14 2 The Division of Highways, Division of Motor Vehicles, Public Service Commission and
15 3 other departments, bureaus, divisions, or commissions operating from special revenue funds 4
16 and/or federal funds shall pay their proportionate share of the public employees health
17 5 insurance cost for their respective divisions.
18 6 The above appropriation for PEIA Subsidy – Surplus (fund 0200, appropriation XXXXX)
19 7 may be transferred to a special revenue fund and shall be utilized by the West Virginia
20 8 Public Employees Insurance Agency for the purposes of offsetting benefit changes to offset
21 9 the aggregate premium cost-sharing percentage requirements between employers and
22 10 employees. Such amount shall not be included in the calculation of the plan year aggregate
23 11 premium cost-sharing percentages between employers and employees.
