1 AN ACT supplementing and amending the appropriations of public moneys out of the Treasury
2 from the balance of moneys remaining as an unappropriated surplus balance in the State
3 Fund, General Revenue, to the Higher Education Policy Commission, Higher Education
4 Policy Commission – Administration – Control Account, fund 0589, fiscal year 2024,
5 organization 0441, by supplementing and amending the appropriations for the fiscal year
6 ending June 30, 2024, by adding new items of appropriation.
1 WHEREAS, The Governor submitted the Executive Budget Document to the Legislature
2 on January 10, 2024, containing a Statement of the State Fund, General Revenue, setting forth
3 therein the cash balance as of July 1, 2023, and further included the estimate of revenue for the
4 fiscal year 2024, less net appropriation balances forwarded and regular and surplus
5 appropriations for the fiscal year 2024, and further included recommended supplemental
6 appropriations from the balance of the State Fund, General Revenue; and
1 WHEREAS, The Governor submitted to the Legislature an Executive Message dated May
2 19, 2024, which included a revised estimate of revenues for the State Fund, General Revenue, for
3 the fiscal year 2024; and
1 WHEREAS, It appears from the Executive Budget Document, Statement of the State
2 Fund, General Revenue, and the Executive message, there remains an unappropriated surplus
3 balance in the State Treasury which is available for appropriation during the fiscal year ending
4 June 30, 2024; therefore Be it enacted by the Legislature of West Virginia:
1 That the total appropriation for the fiscal year ending June 30, 2024, to fund 0589, fiscal
2 year 2024, organization 0441, be supplemented and amended by adding new items of
3 appropriation as follows:

21 XXXXX) at the close of the fiscal year 2024 is hereby reappropriated for expenditure during the
22 fiscal year 2025.
