1 A BILL to amend and reenact §64-10-1 of the Code of West Virginia, 1931, as amended, relating to
2 authorizing the Division of Labor to promulgate a legislative rule relating to minimum wage,
3 maximum hours, and overtime compensation.
Be it enacted by the Legislature of West Virginia:
ARTICLE 10. AUTHORIZATION FOR DEPARTMENT OF COMMERCE TO
PROMULGATE LEGISLATIVE RULES.
§64-10-1. Division of Labor.
1 The legislative rule filed in the State Register on June 6, 2023, authorized under the
2 authority of §21-5C-6 of this code, modified by the Division of Labor to meet the objections of the
3 Legislative Rule-Making Review Committee and refiled in the State Register on September 19,
4 2023, relating to the Division of Labor (minimum wage, maximum hours, and overtime
5 compensation, 42 CSR 08), is authorized.
NOTE: The purpose of this bill is to authorize the Division of Labor to promulgate a legislative rule relating to minimum wage, maximum hours, and overtime compensation.
