1 A BILL to amend and reenact §15-1B-11 of the Code of West Virginia, 1931, as amended, relating
2 generally to uniform and equipment allowances for the National Guard.
Be it enacted by the Legislature of West Virginia:
ARTICLE 1B. NATIONAL GUARD.
§15-1B-11. Uniforms, arms, equipment and supplies.
1 (a) The uniforms, arms, equipment and supplies necessary for performance of duties shall
2 be those prescribed by applicable federal laws and regulations. Officers shall provide themselves
3 with uniforms and equipment prescribed, and there shall be annually allowed, to aid them in
4 procuring and maintaining the same in condition for service, the sum of $100 each or a higher sum
5 not to exceed $500 as determined at the discretion of the Adjutant General. Such sum shall be
6 paid during the last month of each fiscal year for such year. In the event of service for less than the
7 full fiscal year one twelfth of such sum shall be allowed for each month of service during such year.
8 (b) Any member of National Guard requiring a maternity or other specialty may request a
9 sum or reimbursement to offset any expenses incurred in procuring such uniform not to exceed the
10 amount provided in subparagraph a of this section once in a 36-month period. Requests under this
11 subsection are made at the discretion of the Adjutant General. Any approved sum or
12 reimbursement shall be paid during the last month of each fiscal year for such year.
NOTE: The purpose of this bill is to authorize an increase to the officer uniform allowance and to create a maternity and specialty uniform allowance. This bill was recommended for introduction during the 2023 regular session of the Legislature by the Adjutant General.
