1 A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section,
2 designated §49-4-905, relating to allowing for CPS expungement in certain circumstances.
Be it enacted by the Legislature of West Virginia:
ARTICLE 4. COURT ACTIONS.
§49-4-905. Automatic expungement in certain instances.
1 A person who is found not to have committed abuse and neglect through the form of a
2 court order shall be expunged by Child Protective Services ("CPS"). The provisions of this section
3 shall be retroactive to apply to cases where this has happened previously.
NOTE: The purpose of this bill is to allow for CPS expungement in certain circumstances.
