1 AN ACT supplementing and amending Chapter 11, Acts of the Legislature, Regular Session,
2 2022, known as the budget bill, as amended, in Title II from the appropriations of public
3 moneys out of the Treasury in the State Fund, General Revenue, to the Department of
4 Transportation, Division of Multimodal Transportation Facilities – Public Transit, fund
5 0510, fiscal year 2023, organization 0810, by supplementing and amending the
6 appropriations for the fiscal year ending June 30, 2023.
7 Whereas, The Governor submitted the Executive Budget Document to the Legislature on
8 January 11, 2023, containing a statement of the State Fund, General Revenue, setting forth
9 therein the cash balance as of July 1, 2022, and further included the estimate of revenue for the
10 fiscal year 2023, less net appropriation balances forwarded and regular and surplus
11 appropriations for the fiscal year 2023, and further included recommended supplemental
12 appropriations from the balance of the State Fund, General Revenue; and
13 Whereas, It appears from the Governor’s Statement of the State Fund, General Revenue,
14 there now remains an unappropriated balance in the Treasury which is available for appropriation
15 during the fiscal year ending June 30, 2023; and
16 Whereas, On March 30, 2022 the Governor approved House Bill 4492, which re-organized
17 the Division of Public Transit under the newly-created the Division of Multimodal Transportation
18 Facilities of the Department of Transportation; therefore Be it enacted by the Legislature of West Virginia:
1 That the total appropriation for the fiscal year ending June 30, 2023, to fund 0510, fiscal
2 year 2023, organization 0810, be supplemented and amended to read as follows:

15 6 Any unexpended balances remaining in the appropriations for Equipment (fund 0510,
16 7 appropriation 07000), Current Expenses (fund 0510, appropriation 13000), Buildings (fund
17 8 0510, appropriation 25800), and Other Assets (fund 0510, appropriation 69000) at the close
18 9 of the fiscal year 2022 are hereby reappropriated for expenditure during the fiscal year 2023.
19 10 From the above appropriation for Current Expenses (fund 0510, appropriation 13000),
20 11 $30,000 shall be used to support the Sistersville Ferry.
