1 A BILL to amend and reenact §64-9-1 of the Code of West Virginia, 1931, as amended, relating to
2 authorizing the Board of Optometry to promulgate a legislative rule relating to optometric
3 telehealth practice.
Be it enacted by the Legislature of West Virginia:
ARTICLE 9. AUTHORIZATION FOR DEPARTMENT OF MISCELLANEOUS
AGENCIES AND BOARDS TO PROMULGATE LEGISLATIVE RULES.
§64-9-1. Board of Optometry.
1 The legislative rule filed in the State Register on July 30, 2022, authorized under the
2 authority of §30-1-26 of this code, modified by the Board of Optometry to meet the objections of
3 the Legislative Rule-Making Review Committee and refiled in the State Register on September 28,
4 2022, relating to the Board of Optometry (optometric telehealth practice, 14 CSR 12), is
5 authorized.
NOTE: The purpose of this bill is to authorize the Board of Optometry to promulgate a legislative rule relating to optometric telehealth practice.
