1 AN ACT to create 252.047 of the statutes; relating to: waivers from
2 immunization requirements at institutions of higher education.
Analysis by the Legislative Reference Bureau
This bill requires any institution of higher education that receives public
funding and that requires any student or prospective student to receive an
immunization as a condition of attendance to waive the immunization requirement
for a student or prospective student if the student or prospective student objects to
the immunization for reasons of health, religion, or personal conviction. Under the
bill, no institution of higher education may require that a student or prospective
student provide any explanation or justification of the student's or prospective
student's objection to an immunization. Further, the bill requires an institution of
higher education that receives public funding to inform a student or prospective
student of the student's or prospective student's right to a waiver from the institution
of higher education's immunization requirements in writing at any time the
institution of higher education informs the student or prospective student of the
immunization requirements.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
3 SECTION 1. 252.047 of the statutes is created to read:

1 252.047 Waiver from immunization requirements at universities,
2 colleges, and technical colleges. (1) In this section, institution of higher
3 education has the meaning given in s. 39.395 (1).
4 (2) If any institution of higher education that receives public moneys requires
5 any student or prospective student to receive an immunization as a condition of
6 attendance, the institution of higher education shall waive the immunization
7 requirement if the student or prospective student objects to the immunization for
8 reasons of health, religion, or personal conviction. No institution of higher education
9 may require that a student or prospective student provide any explanation or
10 justification for the student's or prospective student's objection to an immunization
11 under this section.
12 (3) At any time an institution of higher education that receives public moneys
13 informs a student or prospective student of any immunization requirements of the
14 institution of higher education, the institution of higher education shall inform the
15 student or prospective student in writing of the student's or prospective student's
16 right to a waiver under this section.
