1 AN ACT to repeal 6.36 (1) (ae) and 343.50 (8) (c) 3.; to amend 6.36 (1) (b) 1. a.,
2 342.06 (1) (eg) and 343.14 (2j); and to create 6.36 (1) (af) of the statutes;
3 relating to: Wisconsin's membership agreement with the Electronic
4 Registration Information Center.
Analysis by the Legislative Reference Bureau
Under current law, the administrator of the Elections Commission is required
to enter into a membership agreement with the Electronic Registration Information
Center (ERIC) to assist the commission in maintaining Wisconsin's official voter
registration list.
This bill terminates Wisconsin's membership agreement with ERIC and directs
the administrator of the Elections Commission to undertake all actions necessary
and proper to effect that termination. The bill also expressly prohibits the
commission and any other state agency from entering into a membership agreement
with ERIC.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
5 SECTION 1. 6.36 (1) (ae) of the statutes is repealed.

1 SECTION 2. 6.36 (1) (af) of the statutes is created to read:
2 6.36 (1) (af) Neither the commission nor any other agency, as defined in s.
3 13.172 (1), may enter into a membership agreement with Electronic Registration
4 Information Center, Inc.
5 SECTION 3. 6.36 (1) (b) 1. a. of the statutes is amended to read:
6 6.36 (1) (b) 1. a. Except as provided in pars. (ae), (bm), and (bn), no person other
7 than an employee of the commission, a county clerk, a deputy county clerk, an
8 executive director of a county board of election commissioners, a deputy designated
9 by the executive director, a municipal clerk, a deputy municipal clerk, an executive
10 director of a city board of election commissioners, or a deputy designated by the
11 executive director may view the date of birth, operator's license number, or social
12 security account number of an elector, the address of an elector to whom an
13 identification serial number is issued under s. 6.47 (3), or any indication of an
14 accommodation required under s. 5.25 (4) (a) to permit voting by an elector.
15 SECTION 4. 342.06 (1) (eg) of the statutes is amended to read:
16 342.06 (1) (eg) Except as provided in par. (eh), if the applicant is an individual,
17 the social security number of the applicant. The department of transportation may
18 not disclose a social security number obtained under this paragraph to any person
19 except to the department of children and families for the sole purpose of
20 administering s. 49.22, to the department of workforce development for the sole
21 purpose of enforcing or administering s. 108.22, and to the department of revenue
22 for the purposes of administering state taxes and collecting debt, and to the elections
23 commission for the sole purpose of allowing the chief election officer to comply with
24 the terms of the agreement under s. 6.36 (1) (ae).
25 SECTION 5. 343.14 (2j) of the statutes is amended to read:

1 343.14 (2j) Except as otherwise required to administer and enforce this
2 chapter, the department of transportation may not disclose a social security number
3 obtained from an applicant for a license under sub. (2) (bm) to any person except to
4 the department of children and families for the sole purpose of administering s.
5 49.22, to the department of workforce development for the sole purpose of enforcing
6 or administering s. 108.22, to the department of revenue for the purposes of
7 administering state taxes and collecting debt, or to the driver licensing agency of
8 another jurisdiction, or to the elections commission for the sole purpose of allowing
9 the chief election officer to comply with the terms of the agreement under s. 6.36 (1)
10 (ae).
11 SECTION 6. 343.50 (8) (c) 3. of the statutes is repealed.
12 SECTION 7.0Nonstatutory provisions.
13 (1) TERMINATION OF ERIC AGREEMENT. This state's agreement with the
14 Electronic Registration Information Center, entered into under s. 6.36 (1) (ae) 1.,
15 2021 stats., is terminated. The chief election officer of this state shall undertake all
16 actions necessary and proper to give effect to this subsection.
