1 AN ACT to create 20.465 (3) (qs) and 256.35 (3s) (bx) of the statutes; relating to:
2 grants for incumbent local exchange carriers for costs associated with Next
3 Generation 911 and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, the Department of Military Affairs must award grants to
public safety answering points, more commonly known as 911 call centers, for a
variety of purposes related to advanced 911 operations, known as Next Generation
911. In addition, under a separate grant program, DMA must award grants to county
land information offices for the purpose of preparing geographic information systems
data to help enable Next Generation 911.
This bill creates an additional grant program under which DMA must award
grants to incumbent local exchange carriers operating as originating service
providers for the reimbursement of the incumbent local exchange carriers' certain
various costs associated Next Generation 911. An “incumbent local exchange
carrier” is defined under the bill to have the same meaning as it does under federal
law. An “originating service provider” is an entity that provides a service that may
be used to generate a request for emergency assistance and that may connect to an
emergency number system.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
1 SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
2 the following amounts for the purposes indicated:

7 SECTION 2. 20.465 (3) (qs) of the statutes is created to read:
8 20.465 (3) (qs) Grant program for incumbent local exchange carriers.
9 Biennially, from the police and fire protection fund, the amounts in the schedule for
10 the department to provide grants under s. 256.35 (3s) (bx).
11 SECTION 3. 256.35 (3s) (bx) of the statutes is created to read:
12 256.35 (3s) (bx) Grant program for incumbent local exchange carriers. 1. In
13 this paragraph, “incumbent local exchange carrier” has the meaning given in 47 USC
14 251 (h).
15 2. From the appropriation under s. 20.465 (3) (qs), the department shall award
16 grants to incumbent local exchange carriers operating as originating service
17 providers for the reimbursement of the incumbent local exchange carriers' costs
18 associated with the IP-based transport of Next Generation 911, the database used
19 to operate Next Generation 911, and the purchase, installation, and maintenance of

1 Next Generation 911 equipment. An incumbent local exchange carrier is not eligible
2 for a grant under this subdivision unless it is acting as an incumbent local exchange
3 carrier in this state on the effective date of this subdivision .... [LRB inserts date].
4 3. The department shall develop a policy that establishes eligibility criteria for
5 grants under subd. 2. The department may seek recommendations from the 911
6 subcommittee on the awarding of grants under subd. 2., including advice on
7 appropriate grant purposes and eligibility criteria for grants.
8 4. The department may not award more than one grant under subd. 2. per
9 incumbent local exchange carrier per fiscal year.
