1 AN ACT to amend 101.022; and to create 440.041 of the statutes; relating to:
2 biennial report on various metrics related to the issuance of occupational
3 credentials.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
JOINT LEGISLATIVE COUNCIL PREFATORY NOTE: This bill was prepared for the Joint
Legislative Council's Study Committee on Occupational Licenses.
The bill requires the Department of Safety and Professional Services (DSPS) to
include the following information in its biennial report to the Legislature, for the time
period since the prior report:
The number of applications for initial, renewal, and reciprocal credentials
received by DSPS and any credentialing board, and the number of those credentials
granted and issued. DSPS must also separately report these numbers for each profession.
The lowest, highest, and median number of days from the day that an application
for initial, renewal, or reciprocal credential is initiated to the date that a final
determination is made. DSPS must also separately report these numbers for applications

in the health professions, business professions, trades professions, all other professions,
and each profession individually.
The median number of contacts made to and received from an applicant for an
initial, renewal, or reciprocal credential before a final determination on the applicant's
credential is issued. DSPS must also separately report these numbers for each profession.
The number of applications for initial, renewal, and reciprocal credentials for
which DSPS or a credentialing board requested more information. DSPS must also
separately report these numbers for each profession.
The number of applications for initial, renewal, and reciprocal credentials that
required DSPS or a credentialing board to review an arrest, conviction, or other offense
record. DSPS must also separately report these numbers for each profession.
1 SECTION 1. 101.022 of the statutes is amended to read:
2 101.022 Certain laws applicable to occupational licenses. Sections
3 440.03 (1), (3m), (4), (11m), and (13) (a), (am), and (b) 75., 440.041, 440.05 (1) (a) and
4 (2) (b), 440.075, 440.09 (2), 440.11, 440.12, 440.121, 440.13, 440.14, 440.15, 440.19,
5 440.20 (1), (3), (4) (a), and (5) (a), 440.205, 440.21, and 440.22, and the requirements
6 imposed on the department under those statutes, apply to occupational licenses, as
7 defined in s. 101.02 (1) (a) 2., in the same manner as those statutes apply to
8 credentials, as defined in s. 440.01 (2) (a).
9 SECTION 2. 440.041 of the statutes is created to read:
10 440.041 Biennial report on issuance of credentials. The department
11 shall, in its report under s. 15.04 (1) (d), include all of the following covering the time
12 period since the previous report:
13 (1) The number of applications for initial credentials, the number of
14 applications for the renewal of a credential, and the number of applications for a
15 reciprocal credential that were received by the department and by any credentialing
16 board and the number of initial credentials, the number of renewed credentials, and
17 the number of reciprocal credentials granted and issued. The department shall
18 separately report for each profession the number of applications for initial
19 credentials, the number of applications for the renewal of a credential, and the

1 number of applications for a reciprocal credential that were received and the number
2 of initial credentials, the number of renewed credentials, and the number of
3 reciprocal credentials granted and issued.
4 (2) The lowest, highest, and median number of days from the day that an
5 application for an initial credential is initiated by an applicant to the date that a final
6 determination on the application is made; the lowest, highest, and median number
7 of days from the day that an application for the renewal of a credential is initiated
8 by an applicant to the date that a final determination on the application is made; and
9 the lowest, highest, and median number of days from the day that an application for
10 a reciprocal credential is initiated by an applicant to the date that a final
11 determination on the application is made. The department shall separately report
12 the lowest, highest, and median number of days for all such applications in the health
13 professions, business professions, trade professions, all other professions, and each
14 profession individually.
15 (3) The median number of contacts made to and received from an applicant for
16 an initial credential, the median number of contacts made to and received from an
17 applicant for the renewal of a credential, and the median number of contacts made
18 to and received from an applicant for a reciprocal credential before a final
19 determination on the applicant's application is issued. The department shall
20 separately report for each profession the median number of contacts made to and
21 received from an applicant for an initial credential, the median number of contacts
22 made to and received from an applicant for the renewal of a credential, and the
23 median number of contacts made to and received from an applicant for a reciprocal
24 credential before a final determination on the applicant's application is issued.

1 (4) The number of applications for an initial credential, the number of
2 applications for the renewal of a credential, and the number of applications for a
3 reciprocal credential submitted for which the department or a credentialing board
4 requested more information. The department shall separately report for each
5 profession the number of applications for an initial credential, the number of
6 applications for the renewal of a credential, and the number of applications for a
7 reciprocal credential for which the department or a credentialing board requested
8 more information.
9 (5) The number of applications for an initial credential, the number of
10 applications for the renewal of a credential, and the number of applications for a
11 reciprocal credential that required the department or a credentialing board to review
12 an arrest or conviction record or any other offense if the offense is reviewable by the
13 department or credentialing board that issues the credential. The department shall
14 separately report for each profession the number of applications for an initial
15 credential, the number of applications for the renewal of a credential, and the
16 number of applications for a reciprocal credential that required the department or
17 a credentialing board to review an arrest or conviction record or any other offense if
18 the offense is reviewable by the department or credentialing board that issues the
19 credential.
