1 AN ACT to amend 940.02 (2) (intro.) of the statutes; relating to: first-degree
2 reckless homicide and providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law, it is a Class C felony to cause the death of another human
being by manufacture, distribution, or delivery of, or by administering or assisting
in administering, certain schedule I or schedule II controlled substances, controlled
substance analogs, or ketamine or flunitrazepam. A Class C felony is punishable by
a fine of up to $100,000 or imprisonment for up to 40 years, or both. This bill
increases the penalty for such conduct from a Class C to a Class B felony. A Class
B felony is punishable by imprisonment for up to 60 years.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
3 SECTION 1. 940.02 (2) (intro.) of the statutes is amended to read:
4 940.02 (2) (intro.) Whoever causes the death of another human being under any
5 of the following circumstances is guilty of a Class C B felony:
