February 14, 2023 - Introduced by Senators CABRAL-GUEVARA, BALLWEG, SPREITZER
and WIRCH, cosponsored by Representatives TUSLER and KITCHENS. Referred

Families.
1 AN ACT to create 767.313 (1) (e) of the statutes; relating to: annulment for
2 marriage if less than one year and no pregnancy.
Analysis by the Legislative Reference Bureau
Under current law, a court may annul a marriage if certain grounds are met,
such as a party lacked the capacity to consent to the marriage, a party lacks the
physical capacity to consummate the marriage, a party did not meet the legal
requirements for marriage, or the marriage is otherwise prohibited by the laws of
this state. This bill adds a new ground for annulment of a marriage if the parties
have been married for less than one year and no pregnancy resulted from the
marriage.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
3 SECTION 1. 767.313 (1) (e) of the statutes is created to read:
4 767.313 (1) (e) The parties have been married for less than one year and no
5 pregnancy resulted from the marriage.
