The proposed bill aims to enhance the preservation of working economic properties in Washington State by establishing a framework for mandatory disclosures to potential purchasers and users of properties adjacent to these areas. It introduces new definitions related to development permits, good management practices, and working economic operations, emphasizing the need for transparency regarding the potential nuisances—such as noise, odors, and dust—associated with living near industrial and maritime activities. Cities are required to create a notice of disclosure for development permits issued within one-half mile of designated working economic properties, ensuring that property owners acknowledge the inherent inconveniences of such locations.
Additionally, the bill stipulates that development permits must include a covenant preventing legal actions against adjacent working economic properties for reasonable activities conducted in the normal course of their operations. This covenant will run with the land and can only be removed under specific conditions. Furthermore, it clarifies that industrial operations conducted in compliance with zoning regulations and good management practices cannot be deemed a nuisance, regardless of changes in surrounding land use. The act is officially titled the Coastal Communities Transparency Act.
