Starting July 1, 2029, producers, renovators, or retailers will be prohibited from selling mattresses unless they are registered with a PRO that has an approved plan, and retailers must inform consumers about collection opportunities for discarded mattresses.
Additionally, the bill mandates that PROs submit detailed plans for mattress collection and recycling, set performance goals with a minimum recycling rate of 70 percent, and provide accessible collection opportunities. It establishes a Responsible Mattress Management Account to manage funds and outlines penalties for non-compliance, allowing civil penalties for violations. The bill also includes provisions for antitrust immunity for participants in the recycling program and clarifies that local governments retain their authority over solid waste collection. Furthermore, it introduces a new section exempting PRO receipts from certain regulations and includes a severability clause to ensure the enforceability of remaining provisions if any part of the act is found invalid.
