This bill introduces a new section to chapter 39.04 RCW, mandating that subcontractors certified by the office of minority and women's business enterprises are indemnified for certain expenses incurred due to late payments from contractors or subcontractors on public works projects. Specifically, if a subcontractor is unable to make timely employer contributions to a Taft-Hartley trust because a contractor or subcontractor has violated the requirements of RCW 39.04.250, the violating party is required to promptly indemnify the subcontractor for any associated fees or penalties.

The provisions of this bill apply to contracts that are entered into or renewed on or after the effective date of the new section. This legislation aims to protect subcontractors from financial repercussions stemming from late payments, thereby promoting fair practices in public works contracting.
